By placing an order on our website, you agree to these Terms and Conditions. 1. Scope and acceptance These Terms and Conditions apply to all contracts between you and MMW Jewelry Designs concerning products ordered through our website. We may update these Terms and Conditions from time to time, and the version accepted at the time of your order will apply to that purchase. If you do not accept these Terms and Conditions, you should not place an order on our website. 3. Products We sell handcrafted jewelry, including small-batch and one-of-a-kind items. Because many products are handmade, minor variations in color, shape, finish, texture, stones, shells, sea glass, or other materials may occur and are not considered defects where they reflect the handmade nature of the product. We do our best to display product descriptions, sizes, and images as accurately as possible, but colors and appearance may vary depending on your device and screen settings. 4. Ordering process You may place an order by selecting products, adding them to your cart, entering your delivery and billing details, selecting shipping and payment methods, and confirming the order at checkout. After placing your order, you will receive an order confirmation email. This email confirms that we have received your order request, but it does not mean the order has been accepted. The contract is concluded only when we dispatch the products and send you a shipping confirmation, or otherwise expressly accept the order. We reserve the right to reject or cancel an order, including where: A product is out of stock. There is an obvious pricing or product description error. Payment cannot be authorized or verified. We suspect fraud, misuse, or unlawful activity. Delivery is not possible to the address provided. 5. Prices and currency All prices shown on our website are listed in the applicable currency and include VAT where required by law, unless otherwise stated. Shipping fees, customs duties, import taxes, and any additional charges are shown separately where applicable. If you order from outside the EU, including the USA, import duties, customs fees, local taxes, and other charges may apply depending on your destination country. These charges are the customer’s responsibility unless otherwise clearly stated at checkout. We reserve the right to correct pricing errors and update prices at any time before an order is accepted. 6. Payment We currently accept payment through Stripe and Danske Bank. Payment may be reserved or authorized at the time of ordering and captured when your order is processed or dispatched, depending on the payment method used. You confirm that the payment information provided is valid and that you are authorized to use the selected payment method. If payment is declined, delayed, reversed, or cannot be completed, we may cancel your order. 7. Delivery We ship using carriers such as PostNord, DHL, DAO, and GLS. Delivery times are estimates only and may vary depending on destination, season, customs handling, and carrier performance. We sell within the EU and to the USA. We do not deliver to PO boxes unless explicitly agreed. The risk of loss or damage to the goods passes to you when the goods are delivered to you or to a person designated by you. If a parcel is returned to us because it was not collected, delivery details were incorrect, or delivery was refused without valid reason, we may charge you the direct costs of return shipping and any additional costs we incur. 8. Right of withdrawal and returns If you are a consumer in the EU, you generally have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days after the day you, or a third party indicated by you other than the carrier, receive physical possession of the goods. To exercise your right of withdrawal, you must notify us clearly by email before the deadline. You must then return the goods without undue delay and no later than 14 days after informing us of your decision to withdraw. Unless the return is due to our error, you are responsible for the direct cost of returning the goods. Returned items must be unused beyond what is necessary to inspect them, and should be returned in original packaging where possible. The right of withdrawal may not apply to: Custom-made or personalized items. Sealed items that are not suitable for return for health or hygiene reasons once unsealed, if applicable. Other goods excluded under applicable consumer law. 9. Refunds If you validly withdraw from a purchase, we will refund the purchase price and the standard outbound delivery cost, if required by law, without undue delay and no later than 14 days after we receive the returned goods or proof that the goods have been sent back, whichever is earlier. Refunds will be made using the same payment method used for the original transaction unless otherwise agreed. We are not responsible for refunding customs duties, import charges, or fees paid to authorities or third parties outside the EU unless required by law. 10. Defects, claims, and legal warranty If a product is faulty, damaged on arrival, or otherwise not in conformity with the contract, please contact us as soon as possible and include your order number, a description of the issue, and photos if possible. Under Danish and EU consumer law, consumers are generally entitled to a minimum two-year legal warranty for defects in goods. Depending on the situation, you may be entitled to repair, replacement, price reduction, or a refund. The legal warranty does not cover normal wear and tear, accidental damage, improper use, lack of care, or damage caused by misuse, impact, chemicals, water exposure where not intended, or unauthorized repair attempts. Because jewelry is delicate, customers should follow reasonable care instructions. Natural patina, oxidation, and normal aging of metals and natural materials are not automatically defects. 11. Incorrect items or transit damage If you receive the wrong item or if the product arrives damaged, please contact us promptly. If possible, keep the packaging and take photos before opening or immediately after discovering the issue. Where we are responsible for the error, we will cover reasonable return shipping costs and offer an appropriate remedy such as replacement, repair, price reduction, or refund. 12. Custom, one-of-a-kind, and handmade items Many MMW Jewelry Designs products are made in small batches or as unique pieces. Slight differences from website photography may occur because of the handmade process and the use of natural or reclaimed materials such as sea glass, shells, gemstones, recycled sterling silver, and copper. Where a product is specifically described as one-of-a-kind, the exact item shown is intended to be the item sold, subject to minor photographic variation. For custom or personalized orders, additional terms may apply, including longer production times and reduced or excluded cancellation/return rights where permitted by law. 13. Intellectual property All content on this website, including text, product descriptions, photographs, graphics, logos, brand elements, and designs, is owned by or licensed to MMW Jewelry Designs and is protected by intellectual property law. You may not copy, reproduce, distribute, modify, or commercially use website content without prior written permission. Purchase of a product does not transfer any intellectual property rights in the design beyond ownership of the physical item itself. 14. Website use You agree not to misuse the website, interfere with its operation, attempt unauthorized access, use automated scraping or extraction tools, or use the website for unlawful purposes. We may suspend, restrict, or terminate access to the website where necessary for maintenance, security, or legal reasons. 15. Limitation of liability Nothing in these Terms limits rights that cannot be excluded under applicable law, including mandatory consumer rights. To the extent permitted by law, MMW Jewelry Designs is not liable for indirect or consequential losses, loss of profit, loss of business, or delays caused by circumstances beyond our reasonable control. Our total liability for a claim relating to a product purchased through the website shall not exceed the amount paid for that product, except where a greater liability applies under mandatory law. 16.
